Hi this is attorney David McKenzie of the Mackenzie law firm and I help people in West Morrison obtained buns of their criminal history in this video we'll discuss what happens after you filed a petition to expunge your Pennsylvania criminal history once you filed the petition the district attorney's office in the county where you file the petition has 60 days to file its response and that response can be either that it agrees with your petition and therefore doesn't object that it does take issue with your request to have your record expunged, and therefore it does object, or thirdly it takes no action at all next the step that occurs is that upon receipt of the District Attorney's response a judge will then do one of three things he will either grant your petition in which case there's nothing further other than you receiving a copy of the order granting the petition the judge can also deny your petition for expungement similarly you'll receive a copy of the order denying your request or what happens in most cases the judge will set a hearing date to address your petition that response by the court will happen and must happen no later than 14 days after the expiration of that 60-day time period mentioned previously now if you have a hearing at the hearing both sides will be afforded an opportunity to be heard and following that hearing the judge will promptly rule on whether to grant or deny your expungement petition if the judge grants the petition for the expungement it's somewhat obvious, but the judge will enter an order directing that expungement take place and the order will contain a myriad of information that I will discuss and do discuss in a separate video the order will be stayed or held for 30 days pending an appeal meaning that the commonwealth if it disagrees with the judges finding that your criminal history should be expunged has 30 days to file an appeal I can tell you in my personal experience that very rarely happens but nevertheless the District Attorney's Office does have that ability if the judge denies the petition for expungement the judge will simply enter an order denying the petition but also stating the reasons albeit usually succinct for the denial if you have any questions about the expungement process in Pennsylvania specifically what I discussed here in this video or what I discussed in other videos or just generally the expungement process in Pennsylvania feel free to call us at the McKenzie law firm we'd be happy to hear from you, and we're here to help thanks for watching you
